Welcome to Lapa.shop! This document (the Offer) outlines the terms under which you may purchase Pets or Services on our platform (referred to as the Marketplace). By placing an order on our Marketplace, you agree to these terms and conditions, which form a legally binding agreement under the laws of England and Wales, including the Consumer Rights Act 2015 and the Electronic Commerce (EC Directive) Regulations 2002.

The operator of this Marketplace is Lapa Pet Promo Ltd, a company registered in England and Wales (Company No. 16114547). The Company acts as a sales agent for legal breeders of cats and dogs from various European countries. We provide partner marketing services, allowing breeders to advertise their kittens and puppies on our website. However, the Company is not the owner or seller of the pets and does not arrange or perform pet transportation. Our business is limited to informational and agency services, for which we receive a commission.

Lapa.shop is designed to provide a safe environment for pet buyers, where they can be confident that the pet they are purchasing comes from a legal breeder whose activity complies with recognised feline and canine breeding standards, as well as relevant animal sales legislation.

Please read these terms carefully before making a purchase. If you do not agree with any part of this Offer, we kindly ask you not to place an order on our Marketplace.

We may update this Offer from time to time. Any changes will take effect as soon as the revised terms are posted on the Lapa.shop website. If the changes significantly impact your rights, we will notify you directly via email or on your account dashboard.

1. Scope of the Agreement

1.1. The purpose of this Agreement is to provide the Buyer with access to the opportunity to purchase Pets and related Services listed on the Marketplace (Lapa.shop).

1.2. This Agreement governs the use of the Marketplace to facilitate the purchase process, including:

  • the Buyer’s voluntary selection of Pets from the Marketplace catalogue;

  • the independent placement of an Order by the Buyer through the Marketplace;

  • payment for the Order made via the Marketplace;

  • forwarding the Order to the respective Breeder (Seller) for processing and fulfillment.

1.3. Lapa.shop acts as a commercial agent and payment facilitator for the Breeder but is not a legal party to the sales contract unless otherwise agreed in writing.

1.4. The specific terms governing interactions between the Marketplace administration, Buyers, and Breeders are outlined in additional policies, which form an integral part of this Offer. Please refer to the Pet Purchase Guidelines and the Breeder Partnership Policy available on the Lapa.shop website.

2. Registration on the Lapa.shop Website

2.1. Registration is not required to place an Order on the Marketplace. Buyers are permitted to make purchases as guests without creating a user account.

2.2. During the checkout process, the Buyer has the option to create a personal account by selecting the checkbox “Create an account?”. In this case, a username will be automatically generated based on the Buyer’s name and email address. A link to set a secure password will be sent to the Buyer’s email.

2.3. For subsequent purchases, the Buyer may log in using the previously created account in order to simplify the ordering process.

2.4. The User agrees not to share their account credentials (username and password) with any third party. If the User suspects that their login details have been compromised or accessed without authorisation, they must notify the Marketplace Administration immediately by emailing lapa.expert@gmail.com.

2.5. The User is solely responsible for any actions carried out on the Marketplace using their login credentials. The Marketplace shall not be held liable for unauthorised access resulting from the User’s failure to protect their account information.

3. Pet Information

3.1. The information about each Pet listed in the Marketplace catalogue is provided for informational purposes only.

3.2. All descriptions and characteristics accompanying each Pet listing are submitted by the respective Seller (Breeder). The Marketplace Operator does not guarantee the accuracy or completeness of this information. For more detailed or up-to-date information, Buyers are encouraged to contact our support team or use the contact forms provided on the website.

3.3. Photographs of Pets displayed on the website may differ slightly from the actual appearance of the animal.

3.4. The Seller provides the Marketplace with photographs of the Pet and grants the Marketplace Operator a royalty-free, worldwide, non-exclusive right to use such images for the purposes of displaying them on the website, as well as for promotional and marketing purposes on other websites, advertising platforms, and social media.

3.5. The Seller may modify the description or photographs of the Pet at any time.

3.6. The Seller is obliged to notify the Marketplace Operator within a reasonable timeframe of any changes related to the Pet, including updates to price, availability, and characteristics. The Seller bears full responsibility for any consequences arising from delayed or incomplete updates, including claims from Buyers based on outdated information.

3.7. The price of the Pet is set by the Seller (Breeder) and may be changed at their discretion. The Buyer acknowledges that the price of a Pet added to their shopping cart is valid only at the time it was added and may be updated before the Order is confirmed.

3.8. The Seller may offer discounts or set promotional prices for specific Pets at their sole discretion.

3.9. In the event of an incorrect price being listed for a Pet ordered by the Buyer, the Seller must contact the Buyer to either confirm the Order at the corrected price or cancel the Order. If the Seller is unable to reach the Buyer, the Order shall be considered cancelled. If the Order has already been paid for at the incorrect price and the Buyer does not accept the updated price, the Seller must refund the full amount paid.

4. Selecting and Ordering

4.1. The Buyer places an Order independently by selecting the desired Pet from the Marketplace catalogue, adding it to the shopping cart, and confirming the selection by clicking the “Proceed to Checkout” button on the cart page. Upon successful submission of the Order, the Buyer will receive an Order Confirmation via the contact details provided at checkout (email and/or mobile phone).

4.2. By placing an Order on the website, the Buyer confirms their acceptance of this Public Offer and provides consent for the processing of their personal data. The Buyer also acknowledges that they have read, understood, and agreed to the Terms and Conditions for Buying Pets on Lapa.shop.

4.3. The Buyer accepts full responsibility for the accuracy of the information provided. The Seller shall not be liable for any delays or issues in order fulfillment caused by incorrect or misleading data submitted by the Buyer.

4.4. To confirm the Order, a Marketplace representative may contact the Buyer to clarify order details and agree on delivery terms. In some cases, confirmation may take place without a phone call, via email or instant messaging.

4.5. If the selected Pet is no longer available, the Seller reserves the right to cancel the Order or offer an alternative Pet of similar characteristics. In the event of cancellation of a prepaid Order, the full payment will be refunded to the Buyer.

4.6. The Seller reserves the right to refuse to fulfil the Order if the Buyer’s submitted information is incomplete or appears to be fraudulent. The Seller may also refuse to transfer a Pet if, in their reasonable opinion, the Buyer is unable to provide appropriate living conditions for the animal. In such cases, the Buyer will receive a full refund.

4.7. The Buyer has the right to cancel their Order within 24 hours of payment. In such a case, the full amount paid will be refunded to the Buyer.

5. Payment for a Pet

5.1. Payments for Pets listed on the Marketplace are collected by Lapa Pet Promo Ltd acting as a commercial agent on behalf of the Seller (Breeder). Upon receiving payment from the Buyer, the Company facilitates the transfer of the respective amount (less commission) to the Seller in accordance with the agency agreement between the parties.

5.2. All payments must be made using one of the secure payment gateways integrated on the Lapa.shop website. Accepted payment methods may include debit or credit cards, PayPal, or other authorised online payment solutions as indicated during the checkout process.

5.3. If the Buyer is unable to make payment using the available methods, they may contact the Marketplace Administration at lapa.expert@gmail.com to request an alternative lawful and traceable payment option. Approval of any alternative payment method is at the sole discretion of the Marketplace Operator.

5.4. All prices displayed on the website are shown in the currency indicated at checkout (GBP, EUR or USD), and include applicable transaction fees, unless stated otherwise. Any exchange rate fluctuations or international transaction charges imposed by the Buyer’s bank or payment provider are the responsibility of the Buyer.

5.5. An Order shall not be considered confirmed until full payment has been received. The Marketplace Operator reserves the right to cancel unpaid Orders without notice.

5.6. Upon receipt of payment, the Buyer will be issued a payment confirmation via email. This email shall serve as proof of payment and confirmation of intent to proceed with the purchase.

6. Pet Reservation and Final Payment

6.1. Buyers are given the option to reserve a Pet in advance by placing a deposit, rather than paying the full purchase price immediately. The standard deposit amount is 50% of the total price, unless otherwise agreed directly with the Breeder.

6.2. A reservation (deposit) is typically used when the selected kitten or puppy will not be ready for travel or collection for at least two weeks. This period allows time for the Pet to reach the appropriate age (usually 12 weeks), complete its vaccination schedule, recover from neutering or spaying (if applicable), and obtain all travel documentation required for rehoming.

6.3. The purpose of the deposit is to secure the Pet exclusively for the Buyer. Once the deposit has been received and accepted, the selected Pet will be marked as “Reserved” and removed from sale. This guarantees that the animal is allocated to the Buyer until final payment is made.

6.4. The reservation becomes binding once payment is confirmed. From this point, the Breeder may only withdraw from the sale in exceptional circumstances, such as if the Pet becomes ill, injured, or dies. In such cases, the Breeder must either:

  • offer a replacement Pet of equivalent value and quality, or

  • refund the deposit in full.

6.5. If the Buyer withdraws from the reservation without just cause, or fails to respond to communications for over one month, the deposit is non-refundable. This policy exists to:

  • ensure that Buyers make an informed and responsible decision before committing to a living animal, and

  • to compensate the Breeder for declining other potential Buyers while the Pet was on hold for you.

6.6. Once the Pet is ready for collection or transport, the Breeder will notify the Buyer accordingly. After agreeing on a delivery date and method, the Buyer must settle the remaining balance before the Pet is released.

Pets will not be handed over or transported until full payment has been received, unless otherwise agreed in writing.

The only exception is where the Buyer and Breeder are located in the same city and agree to complete final payment in person upon handover.

6.7. Payments (both deposits and full payments) can be made securely on the Lapa.shop website via approved payment gateways.

Before submitting any payment, we strongly recommend that Buyers contact the Marketplace team and/or the Breeder to discuss:

  • the Pet’s current status and readiness for rehoming,

  • the Buyer’s living conditions and suitability as a Pet owner, and

  • any special needs or breed-specific requirements of the pet.

The Breeder reserves the right to decline a reservation if, in their reasonable opinion, the Buyer is not able to provide proper care. If a payment has already been made and the Breeder rejects the transaction, the full amount will be refunded within 24 hours.

The Breeder may consult with Lapa.shop regarding the Buyer’s suitability but retains the right to make the final decision.

6.8. In addition, the Buyer has the right to cancel a reservation within 24 hours of payment, for any reason, provided that the payment was made directly through the Lapa.shop website. In this case, a full refund will be issued.

6.9. Buyers may choose to pay the Breeder directly (outside of the Lapa.shop website). However, in such cases, Lapa Pet Promo Ltd cannot guarantee the transaction or act as a mediator in the event of a dispute. For security and transparency, we strongly recommend completing payment via our platform.

6.10. To place a reservation, click the “Pay Deposit” option on the Pet’s page. This will initiate the checkout process for 50% of the listed price. If you wish to pay the full price, select the “Pay full amount” option instead.

7. Returns and Refunds

7.1. Under UK law, living animals are not considered standard consumer goods and are therefore excluded from the statutory 14-day right of cancellation under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This is due to the biological nature of live animals and the individual preparation often required before transfer to the Buyer.

7.2. However, in specific justified cases, a Pet may be eligible for return, replacement, or partial refund. A detailed list of acceptable reasons and conditions for such returns is outlined in our Return and Replacement Policy for Kittens and Puppies, which forms an integral part of this Offer and is available on the Lapa.shop website.

7.3. If a return or refund is approved in accordance with our policy, the Buyer shall bear all transportation costs associated with returning the Pet. Any previously paid delivery charges are non-refundable, as these fees are paid directly to third-party carriers and not to the Breeder or Marketplace.

7.4. In addition, veterinary expenses are not eligible for reimbursement. Only the original price of the Pet, as paid to the Breeder, may be refunded in eligible cases as defined in our policy.

7.5. No refunds will be issued after 30 calendar days from the original delivery or collection date, regardless of the circumstances.

7.6. By mutual agreement between the Buyer and the Breeder, the Pet may be exchanged for another kitten or puppy of comparable value. Such exchanges are handled on a case-by-case basis and are subject to availability and breeder approval. In the case of an approved exchange, all transportation and related expenses shall be borne by the Buyer.

8. Delivery Terms and Conditions

8.1. Lapa.shop does not provide pet transportation services, does not act as a courier company, and does not collect or charge any fees for the delivery of Pets. All transportation is arranged and performed by independent third-party carriers who hold the necessary licences and permits for transporting live animals.

8.2. Upon request, the Marketplace may recommend reliable transport providers to assist the Buyer in organising delivery. In some cases, the Breeder may personally deliver the Pet to the Buyer if mutually agreed and logistically feasible.

8.3. Within Europe, Pets are typically transported by ground (road) using licensed pet transport services. For deliveries to other continents, the animal is transported as air cargo in the aircraft’s hold, in compliance with international live animal transport regulations. Upon special request and if available for the destination, the Pet may be delivered in the aircraft cabin, accompanied by a pet nanny.

8.4. Delivery is never included in the price of the Pet and must be paid separately and directly to the chosen transport provider. Lapa.shop is not a party to the transportation agreement and does not influence the delivery price or process.

8.5. Delivery costs are determined by the carrier and may vary depending on:

  • the destination country and total travel distance,

  • airline tariffs (if applicable),

  • required veterinary or customs documentation,

  • import permits or regulations specific to the country of delivery.

8.6. Buyers are strongly advised to confirm the delivery cost and conditions in advance with the chosen transport provider or the Breeder. Any issues or delays related to transportation should be addressed directly with the responsible courier.

9. Limitation of Liability

9.1. Lapa.shop is an online platform that provides infrastructure for listing Pets offered by approved Breeders and facilitates communication between Breeders and Buyers. Lapa Pet Promo Ltd (the Marketplace Operator) is not a party to the sale agreement between the Buyer and the Breeder unless expressly stated otherwise in writing.

9.2. The Marketplace acts solely as an intermediary, responsible for:

  • publishing information provided by the Breeder;

  • facilitating contact between the Buyer and the Breeder;

  • managing the payment and reservation process on behalf of the Breeder;

  • issuing refunds in limited, clearly defined cases (see Section 8);

  • recommending courier services for delivery when requested.

9.3. The Marketplace reserves the right to:

  • decline to facilitate the reservation or payment process for a Pet to a Buyer without providing a reason, provided no deposit has been paid;

  • refuse further cooperation with a Breeder, provided no outstanding obligations remain between the Breeder and the Marketplace in relation to existing transactions;

  • disclaim liability for the accuracy of any content published on the Marketplace when such content is provided by the Breeder. The Breeder bears sole responsibility for the accuracy of all listings.

9.4. Disclaimer in Specific Cases

Lapa.shop shall not be held liable in the following situations:

  • when the Buyer arranges delivery independently or uses a courier service not recommended or approved by Lapa.shop;

  • when the Buyer contacts the Breeder directly and enters into informal agreements regarding delivery, testing, procedures, or other arrangements not approved in writing by Lapa.shop;

  • when the Buyer disregards advice or guidance provided by Lapa.shop representatives concerning the care or handling of the Pet, resulting in illness or behavioural issues;

  • when the Pet undergoes a procedure deemed unethical or medically harmful, such as declawing;
  • when behavioural problems occur due to the presence of other animals in the Buyer’s home, leading to stress or conflicts;

  • when the Buyer and Breeder enter into a private agreement without written confirmation by Lapa.shop; in such cases, the Marketplace assumes no responsibility for enforcing or mediating that agreement.

9.5. Scope of Marketplace Responsibility

Lapa.shop’s obligations are limited to:

  • displaying Pet listings and descriptions provided by verified Breeders;

  • assisting interested Buyers with inquiries and reservations;

  • accepting deposits and final payments on behalf of Breeders;

  • reserving Pets for Buyers after deposit confirmation;

  • issuing refunds only in the cases outlined in Section 7;

  • retaining the deposit for the Breeder in the event of unjustified Buyer cancellation;

  • facilitating delivery only through recommended or affiliated courier providers (if applicable).

10. Complaints and Dispute Resolution

10.1. If you are dissatisfied with any aspect of your experience on Lapa.shop or wish to raise a complaint, we encourage you to contact our support team in the first instance at lapa.expert@gmail.com. We aim to respond to all enquiries and complaints within 5 working days.

10.2. In case of a dispute between the Buyer and a Breeder, Lapa.shop may, at its sole discretion and without any obligation, assist as an intermediary to help resolve the matter informally. However, Lapa.shop is not a party to the sales contract and cannot guarantee resolution unless explicitly stated otherwise.

10.3. If a complaint relates to payments, deposits, or refunds processed through the Marketplace, the Buyer may request internal review by Marketplace administration. Any such request must be submitted within 30 calendar days of the transaction date.

10.4. If the parties are unable to reach an amicable resolution, either party may refer the matter to formal dispute resolution procedures.

10.5. This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

10.6. In the event of any discrepancy between translated versions of this Offer, the English version shall prevail. This Agreement is originally drafted in English and may be translated for reference purposes only.

11. Cookies and Tracking Technologies

11.1. The Lapa.shop website uses cookies and similar tracking technologies to enhance the user experience, improve website performance, and enable certain essential website functionalities. A cookie is a small data file placed on your device when you visit our website.

11.2. Cookies may be temporary (session cookies), which are automatically deleted when you close your browser, or persistent, which remain stored on your device until they expire or are deleted manually. These cookies help us understand whether you are a first-time or returning visitor, count visits and traffic sources, and improve the performance and usability of the site.

11.3. We use cookies to:

  • deliver relevant content and personalise your experience;

  • remember your preferences and improve navigation;

  • maintain the security of the website and prevent fraudulent activity;

  • monitor website traffic and detect unusual patterns such as automated data scraping or denial-of-service behaviour.

11.4. Cookies do not contain personal data such as your name or contact details, nor do they access information stored on your device.

11.6. By continuing to use our website, you consent to our use of cookies in accordance with our Cookie Policy, which forms an integral part of this Offer and provides more detailed information about the types of cookies we use and how you can manage your preferences.

12. Privacy and Data Protection

12.1. By accepting this Offer, the Buyer consents to the collection and processing of their personal data and preferences related to their activity on the Marketplace. All data is processed in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

12.2. The personal information provided by the Buyer during registration or when placing an Order is used solely for the purpose of:

  • processing and fulfilling Orders,

  • sending status updates and service communications (via email, phone, or other contact methods),

  • improving customer experience and the functionality of the website.

12.3. The Buyer grants the Marketplace the right to:

  • store, access, and update their personal data as required for service provision,

  • include such data in our customer database without additional notice,

  • retain this data for as long as necessary for the stated purposes.

All personal data is handled with strict confidentiality and will not be disclosed to third parties, except:

  • to the respective Seller (Breeder) responsible for fulfilling the Order,

  • to service providers directly involved in the processing and delivery of Orders (e.g. courier services, mobile network providers, mailing services),

  • where required by law or requested by competent regulatory authorities.

12.4. The Marketplace ensures appropriate technical and organisational measures are in place to protect personal data against unauthorised access, loss, or misuse.

12.5. For full details on how we collect, process, store, and protect personal data — as well as information about your rights under data protection law — please refer to our Privacy Policy, which forms an integral part of this Offer.

13. Definitions (Glossary)

For the purposes of this Agreement, the following terms shall have the meanings set out below:

  • Marketplace – the online platform available at https://lapa.shop/en/ which facilitates the listing and promotion of Pets and related Services offered by independent Breeders. Unlike a traditional online store, the Marketplace features listings from multiple Sellers rather than a single vendor.
  • Marketplace Operator / We / Us / OurLapa Pet Promo Ltd, a company registered in England and Wales (Company No. 16114547), with its registered office at 85 Great Portland Street, First Floor, London, England, W1W 7LT. The Company owns and operates the Lapa.shop website and provides marketing and agency services to Breeders.
  • Seller / Breeder – an independent individual or entity engaged in the legal breeding and sale of Pets (pedigree cats and dogs), who lists animals for sale on the Marketplace.
  • Pet / Pets – pedigree cats and dogs offered for sale through the Marketplace by registered Breeders.
  • Services – pet-related services that may be offered through the Marketplace, including but not limited to animal care, transport coordination, or consultancy services.
  • User – any visitor of the Lapa.shop website, regardless of whether they register or make a purchase.
  • Buyer – a User who accepts this Offer and places an Order to purchase a Pet or Service through the Marketplace.
  • Acceptance (of the Offer) – any clear action taken by the Buyer or User that indicates agreement to this Offer, including but not limited to placing an Order or submitting a reservation request.
  • Listing / Offer – information published on the Marketplace in relation to a specific Pet or Product available for purchase.
  • Order – a formal request placed by the Buyer through the Marketplace to purchase a Pet or Service, which may include specific delivery or reservation details.
  • Sale of Pets or Products – the remote conclusion of a sales contract between the Buyer and the Breeder, facilitated through the Marketplace, based on the information and description provided in the listing. The Buyer agrees to the terms without physically inspecting the Pet in advance.
  • Account Dashboard / Personal Account – a password-protected section of the Marketplace available to registered Users, which allows them to manage their Orders, Listings, and personal information.
  • Registration – the process by which a User submits the necessary details via the Marketplace to create a personal account and access member-only features.
  • Status Notification – an automated email, SMS, or in-platform message sent to the User, providing updates regarding Registration, Order status, access to the Account Dashboard, or related matters.
