These return rules apply if other conditions for the return and exchange of animals are not specified in the agreement between the breeder and the buyer.


Good reasons for returning the animal to the breeder
The animal, after leaving the breeder’s home, can be returned to him in exchange for a refund of full or partial payment for it only for valid reasons, the exhaustive list of which is as follows.


Allergy to an animal in family members
A family member who suddenly appeared allergic to animals within a week after the move, which he did not know about before, which was confirmed by an official document from a doctor. Attention! There should be a doctor’s conclusion about the allergy to this animal, and not about the allergy in principle, because it could manifest itself on something else, and the appearance of an animal in the house is a coincidence.


For people with allergies, we recommend that you take an allergy test for the specific animal they are going to buy before purchasing an animal. If an allergic person takes an animal into the house, he is obliged to warn the breeder about his problem, even if the test is passed and it is negative, because such tests can give false results. In case of return of the animal by the buyer with allergies identified before the purchase of the animal, the breeder has the right to keep 100% of the deposit. The amount of the deposit is negotiated individually between the buyer and the seller.


Congenital pathologies
Congenital abnormalities in an animal, if the breeder has not indicated them to the buyer before selling. If the breeder indicated the data of the pathology or characteristics of the animal and the buyer agreed to conclude a contract, these circumstances are no longer the reason for the return.


An infectious disease of an animal that manifested itself in the first 7 days after moving to a new home. This refers to diagnoses officially confirmed by a veterinarian. Buyers’ suspicions of disease cannot be stated as a reason for return. If it is not possible to diagnose the disease in a short time, but symptoms are present, the buyer must provide an official opinion from the veterinarian about the presence of symptoms.


Buyer’s actions to return the animal
For good reasons for returning an animal, we mean only diagnoses officially confirmed by a veterinarian. Thus, the first step of the buyer is to call the veterinarian at home or travel to the veterinary clinic in order to make a diagnosis.


The second step, if an official conclusion is received and it is decided to return the animal, is to send the administration of lapa.shop through a personal account or by e-mail (lapa.expert@gmail.com) a return request. A scan of the veterinarian’s conclusion is attached to the application.


After the administration is notified of the intention to return the animal, the breeder has three days to accept the return of the animal, the details of which are negotiated between the breeder and the buyer in personal correspondence.


When returning the animal, the buyer must put it in the carrier and give it to the courier together with the return form printed from the personal account, as well as with the original veterinarian’s conclusion with a wet seal and signature (a copy is not suitable). The buyer is also obliged to inform the breeder with all the details that the animal has been sent.


After the breeder receives the animal, he is obliged to transfer the money within 3 working days. The buyer, having received the money back, makes a corresponding note in the lapa.shop personal account. Also, if the money is not received, he writes to the administration a complaint about the breeder through his personal account or by e-mail.


The breeder, having received an application for a return, has the right to challenge it in arbitration within 3 days if he considers the application to be inappropriate. The marketplace arbitration tribunal considers it and makes its recommendations within 3 days after the appeal is received. If the reason given by the buyer is listed above and there is documentary evidence, the arbitration will rule in favor of the buyer. If there are not enough reasons, the decision will be in favor of the seller. The decision of the arbitration is not a mandatory guide to implementation, but it is a measure of psychological impact on the parties, as well as an official document for submission to the court, which resolves all disputed points if the parties have not reached a consensus.


Settlement procedure
If the reason for the return is an infection or congenital pathology identified within 7 days from the date of sale of the animal, the breeder returns to the buyer the full cost of the animal, but does not return the money spent by the buyer for checking the health of the animal at the veterinarian and payment for delivery.


If the reason for the return is an allergy and the buyer made a request for a return within 7 days from the date of purchase of the animal, the breeder returns 80% of the cost of the animal (20% remains with the breeder as coverage for preparing the animal for dispatch, shipping costs and compensation for lost opportunities for the sale of the animal to other buyers). If the application is received after 8-20 days, the breeder returns 70% of the cost of the animal. After 30 days, no compensation is made, but the breeder has the right to take the animal if the buyer requests it.


In all cases, the purchaser shall bear the cost of bringing the animal back to the breeder.


Reasons that are not valid
Animal allergy to some kind of irritant, which manifested itself in the buyer’s house. However, the buyer can warn the breeder about this and, in agreement with him, return the animal, if the breeder has the good will of the breeder.


Infectious diseases that arose after 7 days after the animal moved to a new home.


Malformations identified after a while, which did not appear at the time of purchase.


Worms, because this is a frequent occurrence in growing animals, even despite deworming. They are treated with special drugs in 1-2 doses. As a rule, they are not dangerous for people.


Constipation is a common occurrence in kittens after moving to a new home. Stools usually return to normal on their own within 1 week.


The flow of tears from the eyes is not an independent diagnosis, but it can be a sign of a disease. Epiphora, not a valid reason to return, if it is not a symptom of infection or improper eyelid structure.


Diarrhea is not an independent disease, but it can be a symptom of the disease. Diarrhea can occur due to stress or changes in diet and diet. In such case, it is not a valid reason to return. However, if diarrhea is a symptom of an infectious disease received at the breeder’s home, and this is confirmed in writing by a veterinarian, then this pathology may become a reason for returning the kitten to the breeder if it manifests itself in the first 7 days after moving to a new home.


Vomiting is not a reason for returning the animal to the breeder, unless it is a symptom of an infectious disease or congenital pathology and this is officially confirmed by a veterinarian.


Returning an animal without a valid reason
The buyer has the right to return the animal to the breeder within 7 days without a valid reason and without giving any reason, on the condition that the breeder returns 50% of the cost paid for the animal.


Attention! This rule applies only to animals purchased remotely (without a preliminary personal meeting) and for those breeders who use the general rules of the marketplace and have not uploaded their own rules to their page. The buyer should familiarize himself with the rules of the breeder before purchasing by reading the sales contract.


Animal exchange
The breeder and the buyer wishing to return the animal, by mutual agreement, can agree to exchange one animal for another with the characteristics that suit the buyer. This is negotiated separately after the formation of the return request. The financial costs of exchanging animals are then borne by the buyer.
