Lapa.shop’s Public Offer

This proposal (Offer) is addressed to an unlimited number of persons who wish to purchase Pets or Services on Lapa.shop (hereinafter referred to as the Marketplace). The Offer sets the website’s rules and procedures for purchase and sale transactions and governs relations between the Buyer and the Seller.

This Offer is a public contract under the Civil Code of Ukraine (Articles 633, 641) and the Law of Ukraine “On Electronic Commerce” (Article 11).

The Buyer who wants to buy a Pet available on the Marketplace must carefully review the conditions set out in this Offer and accept the terms of the Agreement below. The Agreement takes effect (is deemed concluded) from the moment the Seller receives the Order duly placed by the Buyer.

If the Buyer disagrees with the stated conditions, the Buyer should not order Pets on the Marketplace.

The Marketplace administration has the right to unilaterally change the terms of the Public Offer at any time. Changes shall take effect when the revised Public Offer is posted on the Lapa.shop website.

1. Scope of Agreement

1.1. This Agreement enables the Buyer to purchase Pets available in the Marketplace catalogue.

1.2. This Agreement governs the purchase and sale of Pets on the Marketplace, including:

  • the Buyer’s voluntary selection of Pets in the Marketplace catalogue;
  • placement of the Order on the Marketplace by the Buyer;
  • payment by the Buyer for the Order placed on the Marketplace;
  • processing, fulfilment and transfer of the Order to the Buyer.

1.3. Peculiarities of the Marketplace Administration’s relationship with Sellers and Buyers are included in separate collections of rules, which are an integral part of this Offer. See Lapa.shop website’s Pet Buying Rules and Rules for cooperation with breeders.

2. Basic Concepts

Marketplace is an electronic trading platform hosted on the Internet at https://lapa.shop/. The main difference between the Marketplace and an ordinary webstore is that it offers Pets from different Sellers rather than just one.

Marketplace Administration is an Individual Entrepreneur, Ruslan Mykolaiovych Yuhosh, who is the owner and manager of the Lapa.shop website. Registration data: 79070, Lviv Dovzhenka Street, 16, tax number: 2777908598.

The Seller (Breeder) is an individual who breeds pets and sells them on the Lapa.shop website.

Pets are purebred cats and dogs that are the object of sale in the Marketplace.

Services are pet care and maintenance services, or pet-related consulting services, which may also be sold on the Marketplace.

User is any visitor of the Lapa.shop website.

Buyer is an individual, a user of the website who accepts the terms of this Agreement, intends to order or buy Pets, or buys Pets.

Acceptance is the Buyer/User’s actions to accept the terms of this Offer. Offer acceptance is any step aimed at buying or selling on the Marketplace.

Offer is information posted on the Marketplace about a specific Pet that can be bought by the Buyer.

Order is the Buyer’s duly made request for the purchase and delivery to the address specified by the Buyer of Pets selected on the Marketplace.

Sale of Pets is the process of buying and selling on the Marketplace by concluding an electronic agreement. It occurs after the Buyer reviews the Pet description offered by the Seller in the Marketplace catalogue. This excludes the need for a direct examination of the Pet by the Buyer when concluding the Agreement.

Personal account is a section of the Marketplace available to the User after Registration, using which the User manages their profile.

Registration is the User’s completion of the appropriate form on the website, indicating data necessary for their identification, followed by the entry of the Buyer’s personal data into the Seller’s database.

Status message is a notification sent to the User’s email or mobile phone number, which contains information on the Order status, Registration, access to Personal account, etc.

3. Registration on the Lapa.shop Website

3.1. To place an Order, the User is not obliged to register on the Marketplace. The Buyer can place an Order without an account.

3.2. The Buyer can set up an account when placing an Order. To do this, check “Set up an account?” on the Order page. In this case, the account user login will be generated automatically based on the Buyer’s name and email. A new User will receive a link to their email to set a password for account access.

3.3. During repeated Orders, the Buyer can log in to the created account.

3.4. The User undertakes not to disclose to third parties their login and password specified during Registration. If the Buyer has any suspicions about the security of their login and password or the possibility of their unauthorized use by third parties, the Buyer must immediately notify the Marketplace Administration by sending a corresponding message to lapa.expert@gmail.com.

3.5. The User is solely responsible for all actions performed on the Marketplace on behalf of the User, i.e., using their login and password.

4. Pet Information

4.1. Information on the Pet offered in the Marketplace catalogue is intended for reference only.

4.2. Descriptions and characteristics of the Pet available in the Marketplace catalogue are provided by the Seller (Breeder). The Marketplace Administration does not guarantee the accuracy and completeness of data about Pets offered on the website. To learn more about a particular Pet, the Buyer can refer to the contact centre or the Seller directly during business hours by calling the hotline at +38-067-868-73-87, texting via messenger or using a feedback form on the website.

4.3. Photos of the Pet on the website may slightly differ from the actual appearance.

4.4. Sellers provide the Marketplace with photos of their Pets. At the same time, they grant the Marketplace Administration the right to freely use these photos both to illustrate the Pet on the website and use them on other websites, in ad networks, social media, etc., for the purpose of advertising and marketing promotion of the Seller’s Pets.

4.5. The Seller has the right to change descriptions or photos of Pets at any time.

4.6. The Seller undertakes to notify the Marketplace Administration of all changes related to the Pet, including price, range, availability and characteristics, within a reasonable time. If the Seller fails to notify these changes on time, the Seller shall bear sole responsibility for possible negative consequences of such untimely notification, including the Buyer’s claims related to outdated information about the Pet.

4.7. The price of the Pet is set by the Seller (Breeder) and may be changed at their own discretion. The Buyer agrees that the price of the Pet moved to the Cart will be applicable only at the time of such action and may change until Order confirmation.

4.8. The Seller can provide discounts on Pets, hold promotions, and set special prices for Pets.

4.9. If the price of the Pet ordered by the Buyer was indicated wrong, the Seller must inform the Buyer about this, either to confirm the Order with the corrected price or to cancel the Order. If the Buyer can’t be contacted, the Order will be considered cancelled. If the Order was paid for at the old price, and the Buyer did not agree to the new price, the Seller shall return the entire amount to the Buyer’s payment card.

5. Selecting and Ordering

5.1. The Buyer shall place the Order after choosing the preferred Pet from the Marketplace catalogue, adding it to the Cart and confirming their choice by clicking the “Proceed to checkout” button on the Cart page. After successful placement of the Order, the Buyer will be sent a confirmation message to contact data (email and/or mobile phone) specified during the Order.

5.2. By placing an Order on the website, the Buyer confirms their agreement with the terms of this Offer and consents to the processing of their personal data. 5.2. 5.3. The Buyer is aware of the risk of adverse consequences in case of providing false information, which caused the Seller’s inability to fulfil their obligations to the Buyer properly.

5.4. To confirm the Order, the Buyer may be contacted by a Marketplace consultant who will clarify Order details and agree on the date and time of delivery. The Order can be confirmed without a consultant’s call via email or a message to a mobile phone number.

5.5. If the Pet ordered by the Buyer is unavailable, the Seller has the right to cancel the Buyer’s Order or offer a similar Pet for replacement. If the prepaid Order is cancelled, the paid amount will be returned to the Buyer’s payment card.

5.6. The Seller has the right to refuse to transfer the Pet to the Buyer if the data specified by the Buyer during the Order are incomplete or cause suspicion of their unreliability. Furthermore, the Seller has the right to reject the Buyer if the latter cannot provide adequate conditions for raising a Pet. In case of such rejection, the paid cost of the Order shall be returned to the Buyer’s payment card.

5.7. The Buyer has the right to cancel the Order within 24 hours after payment. In this case, the paid amount will be returned to the Buyer’s payment card.

6. Payment for a Pet

6.1. The Marketplace accepts Order payments from bank payment cards. If the Buyer is unable to pay for the Order by card, they can offer the Marketplace Administration an alternative legal payment method.

7. Pet Reservation

7.1. The Buyer has the option not to pay for the live animal in full but to reserve it for 50% of the price or another share of the cost agreed upon with the Seller. Read more about the advance payment mechanism in our Purchase Rules.

8. Return of Pets and Funds

8.1. According to the legislation of Ukraine, living creatures are not equal to ordinary consumer goods. As such, they are not covered by the provision of the Law “On the Protection of Consumer Rights” regarding the possibility of return within 14 days. However, a Pet can be returned or exchanged, subject to a valid reason. Our Rules for Returning and Exchanging Kittens and Puppies contain a comprehensive list of such reasons.

8.2. If a valid reason is available, the breeder must return the full or partial cost of the Pet or offer an equivalent replacement.

9. Cookies

9.1. A cookie is a small snippet of information sent to the browser and stored on the computer’s hard drive. Lapa.shop website uses cookies to monitor website use and provide services. During browsing, the website may save cookies on the User’s computer. Such temporary cookies are used to count the number of visits to the website. They are deleted as soon as the User exits the browser. Permanent cookies may be stored on the User’s computer by the browser. During Registration, this type of cookie informs the website whether the User is visiting the Marketplace for the first time. Cookies do not contain User’s personal data; they leave out User’s contact data or information from the User’s computer during transmission and can be blocked by the User at any time. Cookies are used exclusively to provide Marketplace Users with the most relevant information; help make the website safer, more secure and more convenient; offer the opportunity to track violations of the Privacy Policy by visitors or devices; provide an opportunity to estimate the number and frequency of requests, as well as detect and block visitors or devices trying to perform batch downloads of information from the website.

10. Confidentiality, Use of Personal Data and Their Transfer to Third Parties

10.1. By accepting this Offer, the Buyer consents to collecting and processing of their personal data and information about their consumer preferences and purchases on the Marketplace, following the Law of Ukraine No. 2297-VI “On Protection of Personal Data”. All Buyer’s personal data are processed under the Law of Ukraine “On Protection of Personal Data.”

10.2. Data provided by the Buyer during Registration or Order placement will be used to process Orders, obtain information on the Order, and send status and informational messages via communication means (email, mobile phone).

10.3. The Buyer grants the Marketplace the right to process their personal data, in particular, include personal data in databases (without additional notification thereof), store data indefinitely, accumulate, update, and change them (as needed). The Marketplace undertakes to protect data from unauthorized access by third parties, not to distribute or transfer data to third parties (except transferring data to Sellers, data processing services for the specified purposes, including mobile carriers, postal mail or courier delivery operators, and upon request of competent state authorities as per the procedure established by law).
